The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe felt a moment of respite on Monday, as the diplomatic emergency triggered by the presentation of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Diplomacy and Destruction

The chain of conflicting incidents captured the bleak nature of the outgoing year. By day, negotiation efforts are waged: optimistic declarations are delivered from multiple capitals. Considerable effort is expended on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, conflict continues to be the primary tool for achieving "peace".

After-Dark Attacks

As military strikes developed into the early hours of Tuesday, the immediate reality of Ukraine's exposure was laid bare. Ukraine is capable of detecting rocket firings from across the border, a ability enabled by current data. From observation points, Ukrainian air force fighter jets that had been deployed to counter approaching aerial threats flew past – modern combat jets provided to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems engaged: several firings fired to intercept a Russian ballistic missile. This was a modern interception technology at work, most likely supplied through partner states. Every firing creates sudden vibrations, rattling buildings. The moment of terror quickly transforms into grim resignation: maybe the approaching threat won't strike its target this time, sparing the city from devastation and another blackout.

Continuous Dangers

Following this, a large-caliber weapon fired at a unmanned aircraft close by, part of a mobile-fire group – probably allied-provided weaponry. Sadly, the shots failed to hit the enemy aircraft – it pressed on overhead toward its target.

With pauses, this persisted until dawn. Kyiv greeted the morning news: several casualties, devastation and utility failures in multiple buildings as a result of the nocturnal offensive. As always, everyone still maintained normal activities – enduring hostilities. But those entire period encapsulated Ukraine's essential dependence on international aid – a reliance that regional partners are clearly incapable to replace in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from Washington generated strong feelings, controversy and deep concern – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and multilateral gatherings.

Every new initiative from American administration unfolds according to the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, manages to fend off. They contain the crisis but never actually win the battle. This pattern will, no doubt, continue.

Strategic Calculations

It is convenient to criticize particular leaders of repeatedly advocating Russian terms. But that does not seem to be the whole story. US administration operates on a premise familiar among international relations experts: you cannot achieve through diplomacy what you have lost on the battlefield. The White House believes that it is impossible to pressure the Kremlin to abandon the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, US leadership does minimal to prevent Kremlin actions, through statements or actions, from thinking that the status quo will not evolve additionally in its advantage in the coming year.

Conflicting Perspectives

Therefore, the Kremlin is certain that time is on his side – that Ukraine and its partners are approaching exhaustion. Their reason to agree to terms that does not give them the greatest potential benefit is close to zero. There may be multiple initiatives to achieve ceasefire, but they will continue as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing lives and land but averting a entire defensive failure until situations evolve in its advantage.

Present Conditions

Realistically, there are no real preconditions for a armistice. Now, individual motivations are entering the equation: leadership ambitions to broker a ceasefire and achieve global acclaim, and Kyiv's dual difficulties – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the country's interests against any plan Kyiv finds unsuitable, so that their attention does not move to homefront challenges. And although their mission will now be much harder after recent developments, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Summary and Prospects

It took a mere seven days to eliminate the suggested clauses of the current initiative. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, recent disclosures, all did their job.

While new plans based on old ideas are imminent, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to resist negotiation assaults from Washington that are rooted in Kremlin requirements and show specific hesitation to change the course of events, if they maintain solidarity and strengthen their defence capabilities at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, largely rely on sustained allied backing.
